MAJOR CORRECTION NOTICE: Apologies to all, some of the areas shown on maps as Environmental Justice Areas in issues prior to this one going back to some time in 2015 have been incorrect. Environmental Justice Areas are determined based on census data. DEP Published an update to the 2010-census data set in 2015, which the mapping published here did not carry properly. Springhill Twp and German Twp are entirely Environmntal Justice in both data sets, so there is no change for these two municipalities; among the areas that did show change were: Georges Twp was Environmental Justice in the 2010 data set but not the 2015 data set; Redstone Twp was not Environmental Justice in the 2010 data set but is in the 2015 data set.
The definition of Environmental Justice Areas is likely to change again "soon", if the current proposal by DEP is implemented to base EJ Areas on census blocks rather than census tracts.

There are numerous "points of note" in the plats for the horizontal wells on the Kovach B Well Pad. In this issue, for the first time, mapping contains what is described in plats as the "mineral tract". It is not clear what this actually means. A common-sense lay person's reading of the term would translate as: the area of subsurface surrounding laterals which is properly leased. There are numerous places in the mineral tract boundary for Kovach B where that boundary is so close to the nearest horizontal that it is almost impossible to believe that fracks will not extend outside the extent of the "mineral tract". This is certainly problematic.
Not showing on this issue's map are parcels from the plats marked "parcel to locate and avoid". These are also problematic. Stay tuned.
The Pennsylvania Superior Court ruled in April 2018 in the first litigation on this subject in Pennsylvania that the "Law of Capture" is not a Right to Fracture, and that fracking outside of leased subsurface is in fact subsurface tresspass. If this ruling stands, the number of cases in which there has been infringement might be substantial. There is a lot at stake here. See Briggs vs. Southwestern Energy, Docket # 1351 MDA 2017,

DEP defines an environmental justice area as "any census tract where 20 percent or more individuals live in poverty, and/or 30 percent or more of the population is minority". (See:

There are supposed to be enhanced public participation requirements for permits in environmental justice areas, but news of this actually ever happening is scarce. In Fayette County, the entirety of Springhill, Nicholson, German, and Georges Townships are environmental justice areas, as well as a large part of Dunbar Township.
