INSPECTION_COMMENT: CEI inspection conducted in response to routine partial inspection conducted by QCS Andrew Zadzilko on 01/20/2021 (IR# 3136472) in which a Notice of Violation was issued for violation of OGA3216(D): Failure to remove production/storage facilities, supplies, and equipment and restore the well site within 9 months of plugging a well. Access road was in good condition at time of inspection, no erosion or sedimentation issues were being caused by access road at time of inspection. According to inspection conducted 12/18/2020 (IR# 3123626), Mr. Mark Kenny, Operator Rep, was contacted and reported that this well was plugged approx. 5 years ago (2015). Well appeared to be plugged during inspection (Photo 1 & 2). No stressed vegetation or signs of leaks were observed at time of inspection. Permanent monument with the well permit number, Operator name, and date of plugging has not been affixed to the plugged well. Well pad has permanent vegetative cover that exceeds 70% ground cover standard. No accelerated erosion or sedimentation issues were observed at time of inspection (Photo 6). Various production piping and damaged brine tank (not in use) remain on site at time of inspection (Photos 3, 4, & 5). At time of inspection, site does not appear to be restored IAW the rules and regulations of the Department. Notice of Violation issued on IR # 3136472 remains outstanding. Recommend operator remove production equipment from site in order to comply with the rules and regulations of the Department.

INSPECTION_COMMENT: CEI inspection conducted in response to routine partial inspection conducted by QCS Andrew Zadzilko on 01/20/2021 (IR# 3136472) in which a Notice of Violation was issued for violation of OGA3216(D): Failure to remove production/storage facilities, supplies, and equipment and restore the well site within 9 months of plugging a well. Access road was in good condition at time of inspection, no erosion or sedimentation issues were being caused by access road at time of inspection. According to inspection conducted 12/18/2020 (IR# 3123626), Mr. Mark Kenny, Operator Rep, was contacted and reported that this well was plugged approx. 5 years ago (2015). Well appeared to be plugged during inspection (Photo 1 & 2). No stressed vegetation or signs of leaks were observed at time of inspection. Permanent monument with the well permit number, Operator name, and date of plugging has not been affixed to the plugged well. Well pad has permanent vegetative cover that exceeds 70% ground cover standard. No accelerated erosion or sedimentation issues were observed at time of inspection (Photo 6). Various production piping and damaged brine tank (not in use) remain on site at time of inspection (Photos 3, 4, & 5). At time of inspection, site does not appear to be restored IAW the rules and regulations of the Department. Notice of Violation issued on IR # 3136472 remains outstanding. Recommend operator remove production equipment from site in order to comply with the rules and regulations of the Department.

"The leachate is stored in 1.9 million gallon glass-lined steel tanks equipped with secondary containment prior to being pre-treated and pumped to the Publicly Owned Treatment Works (POTW) in South Union Township."
This is a major source facility
in an Environmental Justice Area, which means it qualifies as
a so-called Trigger Permit under the DEP Office of
Environmental Justice, which means it should be given a Public
Comment opportunity and assistance obtaining documents. Stay
tuned.
There is reason to question the permit number. Standard practice in the Bureau of Air Quality when a permit is amended is to append a suffix letter the first time the permit is amended, which is then incremented for subsequent amendments. Why is the permit number here not 26-00402A?

published well plat for Siegel 1 above. Its path actually
crosses the path published in the 3/7/21 issue for Siegel
8H, with a difference in depth of only 4 feet! If this is

The closest point of subsurface for this parcel to EQT CHAP LLC's indicated path for the Siegel 2H well bore is approximately 85 feet. This may be relevant in the wake of the Pennsylvania Supreme Court ruling in the case Briggs v. Southwestern Energy.
It is not clear what criteria EQT CHAP, LLC is using to determine "mineral tract boundary" in their plats. (Even less clear is whether DEP has ever given any guidance on this subject.) In many places their published mineral tract boundaries seem to follow the outlines of parcels intersecting the path of the well bore, but in other places this correlation does not seem to stand up. Unfortunately, EQT CHAP omits parcel boundaries in the plats it has published for the Siegel wells, though they are present in the "Area of Review" reports (which do not contain the Mineral Tract Boundary).
