Fayette County Marcellus Shale Permits 6/4/18 - 6/17/18

The big news in this bulletin is DEP finally publishing the location of the long promised air monitoring station for Fayette County. See notes below. DEP's decision to put an additional air monitoring station in Fayette County was entirely due to Fayette Marcellus Watcher public comments.

Also notable is publication of the latest version of the notorious GP-5, the general permit regulating most compressor stations, which many readers of this bulletin know and dread. While the latest GP-5 does have some new provisions regarding methane, the longstanding problems for compressor station neighbors have not been fixed.

Final Technical Guidance—Substantive Revision

 DEP ID: 275-2101-003. Title: Air Quality Permit Exemptions. Description: Consistent with the provision of 25 Pa. Code § 127.14 (relating to exemptions), the Department may determine sources or classes of sources which may be exempt from the plan approval and permitting requirements of 25 Pa. Code Chapter 127 (relating to construction, modification, reactivation and operation of sources). In accordance with 25 Pa. Code § 127.14(d), the Department is finalizing an amendment to the Air Quality Permit Exemptions.

 The Department published a notice at 47 Pa.B. 733 (February 4, 2017) opening a public comment period for Technical Guidance Document No. 275-2101-003, entitled ''Air Quality Permit Exemptions.'' The comment period ended on June 5, 2017. The Department published a second notice at 48 Pa.B. 1902 (March 31, 2018) opening a second public comment period for Technical Guidance Document No. 275-2101-003 on Category Nos. 35 and 38 under 25 Pa. Code § 127.14(a)(8); Category No. 16 under 25 Pa. Code § 127.14(a)(9); and Category No. 40 under the Trivial Activities provision. The comment period ended on May 15, 2018. The Department has prepared a Comment and Response Document which is available on the Department's web site. At this time the Department is finalizing only the revisions to Category Nos. 35 and 38; under 25 Pa. Code § 127.14(a)(9), Category No. 16; and under the Trivial Activities provision, Category No. 40 of Technical Guidance Document 275-2101-003. Any other revisions to the technical guidance document will be finalized at a later date.

 In accordance with section 6.1(f) of the Air Pollution Control Act (35 P.S. § 4006.1(f)) and 25 Pa. Code Chapter 127, Subchapter H (relating to general plan approvals and operating permits), the Department of Environmental Protection (Department) has issued the General Plan Approval and/or General Operating Permit No. 5A for Unconventional Natural Gas Well Site Operations and Remote Pigging Stations (BAQ-GPA/GP-5A) and modifications to General Plan Approval and/or General Operating Permit No. 5 for Natural Gas Compression Stations, Processing Plants and Transmission Stations (BAQ-GPA/GP-5) with an effective date of August 8, 2018.

 The Department published a notice regarding the availability of the proposed GP-5A and proposed revisions to GP-5 for public review and comment at 47 Pa.B. 733 (February 4, 2017). The public comment period was originally scheduled to close on March 22, 2017. However, due to increased public and legislative interest, the comment period was extended until June 5, 2017, at 47 Pa.B. 1235 (February 25, 2017). The Department prepared a comment and response document that summarizes the comments submitted to the Department from 9,357 individuals and organizations during the public comment period.

 On March 31, 2018, the Department published a second notice of the availability of the proposed GP-5A and proposed revisions to GP-5 for public review and comment in full compliance with 25 Pa. Code § 127.612 (relating to public notice and review period). The notice was published at 48 Pa.B. 1902 (March 31, 2018), in six newspapers of general circulation and sent to nearby states and the United States Environmental Protection Agency. The public comment period ended on May 15, 2018. The Department prepared a comment and response document that summarizes the comments submitted to the Department from 32 individuals and organizations during the second public comment period.

 Applicants may seek authorization to use GP-5A or GP-5 by submitting the General Permit application to the appropriate Department regional office. Applicants must receive the Department's written approval prior to constructing and/or operating sources under these General Permits. The newly revised general permits, GP-5 and GP-5A, will be required for new natural gas wells and new compression, processing and transmission stations along pipelines, respectively. The Department will publish notice of each authorization to use GP-5 or GP-5A in the Pennsylvania Bulletin.

Pennsylvania's 2018 Annual Ambient Air Monitoring Network Plan

 The Department of Environmental Protection (Department) is seeking public comment on Pennsylvania's 2018 Annual Ambient Air Monitoring Network Plan (Plan). The Plan has been updated to address changes that have been made in the Commonwealth's ambient air monitoring network and to identify changes that are anticipated to occur in the remainder of 2018 and in 2019.

 On October 17, 2006, the United States Environmental Protection Agency (EPA) promulgated final amendments to the National ambient air monitoring requirements for criteria pollutants in 40 CFR Parts 53 and 58 (relating to ambient air monitoring reference and equivalent methods; and ambient air quality surveillance). See 71 FR 61236 (October 17, 2006). The EPA's final rule requires state and local agencies to enhance air monitoring to ''improve public health protection and better inform the public about air quality in their communities.'' Under 40 CFR 58.10 (relating to annual monitoring network plan and periodic network assessment), air quality state and local monitoring agencies must adopt an annual air monitoring network plan and make the plan available for public inspection for at least 30 days prior to final submission to the EPA Regional Administrator. The Plan, which is due July 1, 2018, must include a statement of purpose for each monitor and evidence that siting and operation of each monitor meets Federal requirements. The EPA may also provide an opportunity for review and comment prior to approving or disapproving a state's monitoring network plan.

Proposed State Implementation Plan Revision; Certification of Reasonably Available Control Technology for Control Techniques Guidelines under the 2008 8-hour Ozone National Ambient Air Quality Standards; Incorporation of 25 Pa. Code Chapter 122 into the Commonwealth's State Implementation Plan Public Hearings

 The Department of Environmental Protection (Department) is proposing to submit a State Implementation Plan (SIP) revision to the United States Environmental Protection Agency (EPA) as required by the Clean Air Act (CAA) (42 U.S.C.A. §§ 7401—7671q) and the implementing regulations under the 2008 ozone National Ambient Air Quality Standards (NAAQS). This proposed SIP revision certifies that the Department is implementing regulations that meet reasonably available control technology (RACT) based on the EPA's Control Techniques Guidelines (CTG) for the 2008 ozone NAAQS. The Department is also requesting that the EPA include as part of this SIP revision 25 Pa. Code Chapter 122 (relating to National standards of performance for new stationary sources), which incorporates by reference the Federal New Source Performance Standards (NSPS) in 40 CFR Part 60 (relating to standards of performance for new stationary sources) to address RACT for certain CTG source categories.

 Section 172(c)(1) of the CAA (42 U.S.C.A. § 7502(c)(1)) provides that SIPs or SIP revisions for areas in nonattainment of a NAAQS must include plan provisions to provide for the implementation of all reasonably available control measures as expeditiously as practicable (including reductions in emissions from existing sources in the area as may be obtained through the adoption, at a minimum, of RACT) and must provide for attainment of the NAAQS. Section 182(b)(2) of the CAA (42 U.S.C.A. § 7511a(b)(2)) provides that for certain nonattainment areas, states must revise their SIPs to include provisions to require the implementation of RACT under section 172(c)(1) of the CAA with respect to each category of volatile organic compound (VOC) emissions covered by a CTG document issued before or after November 15, 1990.

 Under section 184(b)(1)(B) of the CAA (42 U.S.C.A. § 7511c(b)(1)(B)), in accordance with section 110 of the CAA (42 U.S.C.A. § 7410), each state included within a transport region established for ozone must submit a SIP revision which, among other things, requires the implementation of RACT with respect to all sources of VOCs in the state covered by a CTG issued before or after November 15, 1990.

 The Department is including the following items as part of this SIP revision:

The company INR OPERATING LLC seems to have bought out the assets of Burnett Oil in Fayette County. Burnett was issued a prior permit # 051-24636 for a well called "Coastal 2V", originally issued on 2016-06-22, and renewed on 9/19/2017. (A Drill & Operate Well permit is good for one year; if the well is not drilled during that year, the operator has to apply for a renewal.) It's not clear why INR chose to apply for Coastal 2V with a new API Number; that is possibly a mistake. (The current authorization 1231002 above is an application of type "New" instead of "Renewal".) [Repeat note from the 5/20/18 issue of this bulletin:] The site BAER WELL SITES was the subject of a prior Notification application, which was denied on 3/20/2018. (See the 03/25/18 issue of this bulletin.) We can't really tell without having the actual application documents, but it is likely this is a "termination notice" for the well pad Erosion & Sedimentation permit. This site was the subject of successful litigation against Chevron by the split-estate surface owner, and became famous when a surface owner placed her ancestor's ashes at the property entrance, as required by her religion, and Chevron went to court to have the ashes taken down.

DEP defines an environmental justice area as "any census tract where 20 percent or more individuals live in poverty, and/or 30 percent or more of the population is minority". (See:

There are supposed to be enhanced public participation requirements for permits in environmental justice areas, but news of this actually ever happening is scarce. In Fayette County, the entirety of Springhill, Nicholson, German, and Georges Townships are environmental justice areas, as well as a large part of Dunbar Township.
