pale blue: 3
middle blue: 4
dark blue: 6
dark purple: 9

(Color coding may differ from one issue to the next.)
(Note if a project spans multiple municipalities -- e.g. a pipeline -- it will show in the count for each municipality.)

The number of facilities also follows the municipality name in brackets.

Municipality counts are based on the way the permit is listed by DEP; DEP has been known to get a municipality wrong.

Locations in brackets identify a precise location used to locate a surrogate for the actual site being permitted (e.g. locating a well pad or pipeline by the known location of a well.) Locations labeled beginning with "~" and ending in "[?]" are approximate and speculative based on inferences using on-line property and lease records. These are marked in the text as "[Approximate, Speculative]

Orange triangles: Storage Field Wells (currently Dominion North Summit Storage Field)
Crosses: SPUD Unconventional well permits
Green: "Natural areas", e.g. state game lands, state forests

Draft Technical Guidance—Substantive Revision

DEP ID: 012-0501-002. Title: Environmental Justice Public Participation Policy. Description: Historically, minority and low-income residents of this Commonwealth have not had equitable opportunities to participate in decisions that may adversely impact their environment. This policy outlines opportunities for community involvement and public participation in the individual permit application process in Environmental Justice Areas. The revisions to this policy clarify how individuals living in Environmental Justice Areas may have additional opportunities to engage with the Department and permit applicants through public meetings, public comment periods, public access to permit documents and other measures in the effort to increase participation throughout decision making processes. To accurately capture the number of residents of this Commonwealth living in Environmental Justice Areas, the Department updated its definition of Environmental Justice Area to be ''Any census block group with a 30 percent or greater minority population or 20 percent or greater at or below the poverty level as defined by the U.S. Census Bureau.''

Written Comments: Interested persons may submit written comments on this draft policy through Tuesday, August 28, 2018. All comments, including comments submitted by e-mail, must include the originator's name and address. Commentators are encouraged to submit comments using the Department's online eComment tool at www.ahs.dep.pa.gov/eComment or by e-mail to ecomment@pa.gov. Written comments may be mailed to the Technical Guidance Coordinator, Department of Environmental Protection, Policy Office, Rachel Carson State Office Building, P.O. Box 2063, Harrisburg, PA 17105-2063. Comments submitted by facsimile will not be accepted.

Contact: Questions regarding this technical guidance document should be directed to John Brakeall at jbrakeall@pa.gov or (717) 783-9731.

Effective Date: Upon publication of notice as final in the Pennsylvania Bulletin.

<http://files.dep.state.pa.us/Water/Drinking%20Water%20and%20Facility%20Regulation/WaterQualityPortalFiles/Stream_Packages/Tunkhannock_Creek/DunbarCreekDraftReport.pdf>

Conclusion:

"Based on the 2006 benthic macroinvertebrate survey and the 1996 –2002, 2006,and 2016 water chemistry results; the Department recommends that Glade Run from Rock Run to mouth be delisted from the Commonwealth’s 303(d) list of impaired waters. In addition, the UNT 38212 basin should be added to the listing as Source – Abandon Mine Drainage and Cause – Metals and pH(Figures 1 & 2) .

Based on applicable regulatory definitions and requirements of § 93.4b(b)(1)(v ) (the Department’s integrated benthic macroinvertebrate scoring test) the Department recommends that Dunbar Creek basin from and including Limestone Run to Gist Run be redesignated EV; and Dunbar Creek basin from source to and including UNT 38188 and Irishtown Run basin , excluding the headwaters of Glade Run upstream of State Game Lands 51 and those reaches of the Glade Run basin listed or recommended for listing on the Commonwealth’s 303(d) list of impaired waters, be redesigned EV based on § 93.4b(b)(1)(iii) (outstanding State resource waters) (Figures 1 -3).

This recommendation adds approximately 40.2 stream miles of EV waters to Chapter 93."

PROPOSED RULEMAKING
ENVIRONMENTAL QUALITY BOARD
[ 25 PA. CODE CH. 78a ]
Unconventional Well Permit Application Fee Amendments
[48 Pa.B. 4100]
[Saturday, July 14, 2018]

The Environmental Quality Board (Board) proposes to amend §§ 78a.1 and 78a.19 (relating to definitions; and permit application fee schedule) to read as set forth in Annex A. This proposed rulemaking complies with the obligation of the Department of Environmental Protection (Department), as specified in § 78.19(e) (relating to permit application fee schedule) and § 78a.19(b), to provide the Board with an evaluation of the well permit application fees in Chapters 78 and 78a (relating to oil and gas wells; and unconventional wells) and recommend regulatory amendments to address any disparity between income generated by the well permit application fees and the cost of administering 58 Pa.C.S. Chapter 32 (relating to development) (2012 Oil and Gas Act) by the Department's Office of Oil and Gas Management (collectively, the Oil and Gas Program (Program)). This proposed rulemaking increases the current well permit application fees from $5,000 for nonvertical unconventional wells and $4,200 for vertical unconventional wells to $12,500 for all unconventional well permit applications. Because these proposed fee amendments only apply to Chapter 78a and not Chapter 78, conventional well operators are not affected by this proposed rulemaking.

This proposed rulemaking was adopted by the Board at its meeting on May 16, 2018.

Notes:

25 PA Code § 78a.59b Well development impoundments referred to above includes:

(b)  A well operator using a well development impoundment prior to October 8, 2016, shall register the location of the well development impoundment by December 7, 2016, by providing the Department, through the Department’s web site, with electronic notification of the GPS coordinates, township and county where the well development impoundment is located as well as certification as to whether the impoundment meets the requirements in subsections (d), (e) and (h). Any impoundments that do not comply with the requirements in subsections (d), (e) and (h) shall be upgraded to meet these requirements or restored in accordance with subsection (g) by October 10, 2017.

The Previous permit for the Range Resources Rumbaugh Compressor Station shows in the PA Bulletin (October 19, 2013) as:

GP5-26-00483C: Range Resources-Appalachia, LLC (100 Throckmorton Street, Suite 1200, Fort Worth, TX 76102) on October 01, 2013, to authorize continued operation of previously installed One (1) Caterpillar, Model G3516 LE- 4EK03170, 4SLB, natural gas fired compressor engine rated at 1,340 bhp, One (1) Natco, TEG Dehydrator, Model SB12-6, rated at 5.0 MMscf/day and attached to a reboiler rated at 0.25 MMBtu/hr, and Five (5) Storage tanks of various capacities at their Rumbaugh Compressor Station in Lower Tyrone Township, Fayette County.

Authorization 1235324 above for the site STEWART WELL CONNECT appears to be the first instance ever to appear in this bulletin (going back to 2011!) to carry a status of "Waived". Apparently DEP is telling Laurel Mountain Midstream that they didn't need a permit at all -- though this is complete speculation.

The eFACTS system as presented to us over the Web -- outside of DEP -- unfortunately does not allow a query parameter for the Status field. (This is extremely unfortunate; it would be nice to be able to query for Status Pending!)

---
The notice for Authorization 1234198 above is no less than Chevron's third try for what appears to be a "termination notice" for the Erosion & Sedimentation Permit for the Baer Well Pad. (No wells were actually drilled on this pad.) See the 5/20/18 issue of this bulletin for more information about this site.

------------------------
DEP defines an environmental justice area as "any census tract where 20 percent or more individuals live in poverty, and/or 30 percent or more of the population is minority". (See:
<http://www.dep.pa.gov/PublicParticipation/OfficeofEnvironmentalJustice/Pages/default.aspx>). There are supposed to be enhanced public participation requirements for permits in environmental justice areas, but news of this actually ever happening is scarce. In Fayette County, the entirety of Springhill, Nicholson, German, and Georges Townships are environmental justice areas, as well as a large part of Dunbar Township. DEP's policy document on public participation guidelines for environmental justice areas is located here:
<http://www.elibrary.dep.state.pa.us/dsweb/Get/Version-48671/012-0501-002.pdf>

eNOTICE records are likely to list the same permit multiple times, as that permit moves through the DEP process.

Oil & Gas Wells designated with a site a number and the letter H typically designate horizontal wells.

Notice of any new permit applications will appear at the above web address.  I'm not aware of any subscription service to be notified of such applications. I'm not aware of any Marcellus Shale waste disposal injection wells in Fayette County (yet ...) but we need to monitor this page for future applications.

Disclaimers:

This compilation from the above sources was done in part by hand using copy and paste and in part using automated methods; it may omit relevant permits.

Parcel data is provided via the tax records search web page offered by the Fayette County Assessment Office (http://property.co.fayette.pa.us/). Presumed Parcel Id links are subject to availability provided by that agency and associated web sites. Presumed Parcel Ids are determined as the mapped parcel containing a given latitude and longitude, are a best effort determination which is subject to error, and are not official. In cases where a facility is leased and there is a separate parcel id for the lease, if this parcel id is not separately mapped, the parcel id shown will be the id for the enclosing parcel. Parcel owners may be surface owners only and may or may not have any relationship to oil & gas facilities.

Does not currently include water supply permits. Does not include landfill permits even though many such are for Marcellus Shale waste. (It is not possible at this time to distinguish which landfill permits are for Marcellus Shale waste and which are not without doing File Review for each permit.)

Erosion & Sedimentation permit records do not currently include latitude and longitude. Where I am publishing latitude and longitude with E&S permits it is by inferring an associated well permit and using published latitude and longitude for the well. It is possible I may be inferring the wrong well site.

Municipalities are shown from eFACTS records on the DEP web site. The DEP has been known to list a municipality incorrectly.
